False imprisonment
- Case Study
- 05 Nov 2014
From time to time we do cases that are a little outside the normal run of the mill. One such case finished in 2010 for a young man who although only 18 years of age had been charged by police with fairly serious offences. Whilst waiting for the charges to come up he was released on bail subject to strict reporting conditions.
He went to Green Valley Police Station at about 5.20pm to report as required only to find himself placed under arrest and charged with breach of bail for arriving 20 minutes late!
He was kept in custody overnight and when he appeared before the court the next day the charge was thrown out because, just as he had protested all along, his bail conditions had been changed to allow him to report up to 6.00pm.
His father came to us and we took proceedings for wrongful arrest and false imprisonment, which were heard and determined in his favour.
